Many foreign buyers underestimate how legally binding it is. Here’s what you really need to know:


🔹 What is the ‘Compromesso’?


➜ It’s the preliminary purchase agreement ('Contratto Preliminare di Compravendita'). Once both parties sign, they are legally obliged to complete the purchase. 


🔹 Is it binding?


➜ Yes. The ‘Compromesso’ has legal consequences under the Italian Civil Code (Art. 1351, 1385 and 2932). Backing out may result in losing your down payment (‘Caparra confirmatoria’). 


🔹 How much do you pay?


➜ Typically 10–30% of the purchase price.


This amount is later deducted at the final deed (Rogito).


🔹 Why is this crucial for foreign buyers?


➜ Because the ‘Compromesso’ is often signed before all technical/legal checks are completed. You should have clarity on:


✔ ownership structure

✔ outstanding loans or mortgages

✔ cadastral records, building and zoning compliance

✔ urbanistic and technical conformity


🔹 Should you do this alone?


➜ No — especially if you don’t fully speak the language or understand the legal system.
